Organisationally, do we need to ask our members for copies of their driver's licence and car insurances?

JE Jason Emmins Public Seen by 52

Discussion came up at the Risk Jedi (linked to Hooman Jedi) regarding the risk we as an organisation may face if one of our members has a car accident whilst conduct work related business and we have not checked if they have appropriate insurance (i.e. car, third party insurance, comprehensive insurance, valid drivers licence etc).

Do we need to consider asking our members, annually, for their updated insurances and copies of drivers licences? If we don't, what risk may this pose? If we do, what risk may this pose?

I'm undecided - is there going to be the expectations of members to maintain comprehensive insurance on their vehicle if this is implemented? I think it is a yes for the license as i would assume its a requisite to maintain our employment as community based workers and should need to communicate with Jeder if this is suspended for any offences.

Would only be relevant to members who are transporting NDIS Participants. If transporting NDIS Participants then absolutely essential. With most insurers there is the option of using car for business sometimes option, which generally does not increase your premium.

As a non driver due to my vision impairment I utilise the services of a Support Worker to get me to my appointments. I will have a chat with him regarding his own insurance and MY work related travel. Good food for thought.

Yes we must. If we are a childsafe organisation, etc and we have a duty of care, should we not already be doing this? Any support workers are expected to have these ,It is also an expectation that your vehicle is registered for insurance purposes. too many what if's buts and maybes for this one.

I think a couple have brought up some good questions and I would like clarity before voting yes!

In my previous employment where I was using my car as part of conducting business. I was required to provide the mentioned documents.

I also checked with my car insurance NRMA regarding using the vehicle. The response was unless the car is registered under a business name, it is considered private usage.

As far as insurance goes its part of our vehicle registration to have compulsory CTP greenslip which covers personal injury as a result of an incident, so unless we are transporting participants (which probably creates other discussions) i don't feel the insurance is needed.

Thanks Dane- the CTP in NSW predominately protects the driver of the motor vehicle from liability if they were to injure or cause the death of a person or people. Covers the cost of most injuries caused by your vehicle to the people involved in an accident, including the driver (if the accident occurred in NSW). Does not cover the cost of damaged vehicles or property.

Some more info here- What am I covered for? | Green Slip Price Check (nsw.gov.au)

I mean irrespective of if a member had CTP, 3rd part or comprehensive insurance i wouldn’t believe that Jeder is liable if a member were to crash so I don’t know why they would need a copy of insurance. I think an issue may arise for it a member we’re transporting a participant and how this would be covered under our insurances personal/organisational. I think another question would be if an instance like this would be covered under work cover if we are using personal vehicle to get to/from an appt as technically it is our work place.
