Statement on the aadhaar judgement

PP Pirate Praveen Public Seen by 260

We should come up with a response to the judgment and highlight our manifesto which calls for scrapping aadhaar.

Draft

We are disappointed by the majority judgment which failed to protect people's fundamental right to privacy. We welcome the minority judgment by Justice DY Chandracud and hope it will eventually become the reality. Indian Pirates are committed to scrap Aadhaar completely as proclaimed in our Manifesto and invite all democratic forces to join hands in our quest to scrap it.

https://thewire.in/law/justice-chandrachud-dissent-aadhaar-verdict I think Justice Chandrachud's minority judgment will help us in convincing people.

I've made some points here.

Important - judgment undermines parliamentary process by recognizing the Aadhaar Act as a valid money bill and opens the route to rogue governments bypassing the Rajya Sabha to get laws made.

Stress on tech illiteracy - the judgment does not consider the technological ramifications adequately. Also the impact on the poor - they are the ones who have actually died from denial of their PDS and pensions and such and Section 7 has been upheld by the Supreme Court. We see a class bias in their lives and rights not mattering.

There's more in the post.

as @akshay has mentioned in the end of the blog post, Ministry of Electronics and Information Technology has invited feedback on a draft Personal Data Protection Bill. i think we should provide our feedback on the same. we could start a new thread if needed, the deadline is near which is September 30.
